These Terms of Service ("Terms") govern your use of ForkStar at forkstar.io (the "Service"). By creating an account or using the Service you agree to these Terms.

The Service

ForkStar provides tools for restaurants to request reviews from guests, collect private feedback, and track guest activity. We may add, change, or remove features at any time.

Your account

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 and authorized to act for the restaurant you register.

Your data and responsibilities

You retain ownership of the guest data you upload. By using the Service you represent that:

• You have a lawful basis to contact the guests you upload (for example, they are your customers) and that your use complies with applicable laws, including anti-spam laws such as CAN-SPAM and TCPA where applicable.
• You will honor guest opt-outs.
• You will not use the Service to send unlawful, deceptive, or unsolicited bulk messages, or upload data you have no right to use.

ForkStar routes guests who report a positive experience toward public review platforms and delivers other feedback privately to you. You are responsible for ensuring this practice is permitted by the review platforms you link to and by the laws of your jurisdiction.

Acceptable use

• No attempts to breach, probe, or overload the Service.
• No reselling or white-labeling the Service without our written consent.
• No use of the Service to post or solicit fake reviews.

Fees

Paid plans, prices, and billing terms are presented at purchase. Fees are non-refundable except where required by law. We may change prices with at least 30 days' notice.

Termination

You may cancel at any time. We may suspend or terminate accounts that violate these Terms. Upon termination we will delete your data in accordance with our Privacy Policy.

Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee specific outcomes, including review volume or ratings.

Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages.

Changes to these Terms

We may update these Terms from time to time. Material changes will be announced to account holders by email at least 14 days before taking effect. Continued use after that constitutes acceptance.
